Complainant, a former employee, was terminated from employment for rule violations, including workplace violence and threatening a co-worker. Subsequent to termination, Complainant filed a Complaint with the Pennsylvania Human Relations Commission alleging harassment/discharge based upon race and retaliatory discharge. The potential liability included the reinstatement of Complainant and civil penalties.
Chartwell attorney, Robert J. Baker, obtained a dismissal of the Complaint with a finding of no probable cause, through the submission of a body of evidence demonstrating compliance with the employer's policies and procedures as well as the compelling testimony from the victim of the workplace violence.
