Scranton, PA - Chartwell Law partner Anthony P. Trozzolillo successfully received a defense verdict in a wrongful death medical malpractice case. Trozzolillo represented the Scranton Counseling Center and its crisis worker when the daughter of a woman who committed suicide brought a wrongful death claim against them alleging that her mother met thecriteria for 302 Involuntary Admission during a hospital visit in which she claimed fleeting suicidal ideation.
The daughter alleged that the crisis worker, who evaluated the woman at the hospital, had the responsibility to admit her mother invoking 302 Involuntary Admission proceedings. The crisis worker did evaluate the decedent, who claimed she was no longer suicidal and refused voluntary treatment. The crisis worker then consulted with the decedent’s long-time treating psychiatrist, and determined that involuntary hospitalization was not necessary at the time.
After seven days of trial, the jury returned a verdict in favor of the Scranton Counseling Center and its crisis worker.
