Congratulations to Nicholas Switach and Marissa Huber, partners in Chartwell’s New York office, for securing a major victory in a New York Workers’ Compensation case involving a construction-related claim.
In this case, the claimant initially suffered a minor hand injury but later alleged extensive injuries to his neck, back, right shoulder, elbow, and wrist. Through sharp cross-examination, Nicholas and Marissa dismantled these claims. They exposed inconsistencies in the claimant’s statements, including hospital reports explicitly contradicting his claims.
The Judge ultimately found that the alleged neck and back injuries—despite resulting in surgery—were “complete fabrications” and disallowed the claims entirely. Additionally, the claimant’s right shoulder, elbow, and wrist injuries were dismissed outright, and our client was discharged on coverage, with the court determining they were not the proper employer.
