We are proud to share that Chartwell Law partners Shannon Arsenault and Matthew Olmsted successfully obtained summary judgment in favor of the Elk’s Lodge in a significant wrongful death case involving claims of negligent security.
The case stemmed from a tragic shooting that occurred outside the premises during a party hosted by a law-abiding motorcycle club. The shooter, a member of an outlaw motorcycle gang, fired from the public street, killing a man.
Despite allegations that the Elk’s Lodge failed to provide proper security, Shannon and Matthew vigorously defended the case, arguing that the incident was neither foreseeable nor preventable as there had been no history of violence on the premises, and the shooting took place on a public street.
The court ruled in favor of our client, successfully blocking the plaintiff's multi-million-dollar demand. Read the Defendant's Motion for Summary Judgment here.
